Question
Is there anyway to get permission to marry without my legal guardians consent? I am a mother and my fiance and father of my child is in the military. We want to get married.
Answer
In Arizona, a person under 18 cannot get married unless she receives the consent of a parent or guardian that has custody over her. If someone is under 16, that person cannot get married without the consent of a parent or guardian who has custody over her AND the approval of a superior court judge in Arizona. See A.R.S. § 25-102
, which discusses the consent required for a minor to get married and a list of things that the judge must ensure before consenting to the marriage.
